Right of Withdrawal for Consumers 

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.)

Right of Withdrawal

You have the right to withdraw from this contract within one month without giving any reason.

The withdrawal period is one month from the day,

• on which you or a third party named by you, who is not the carrier, took possession of the goods, provided you ordered one or more goods as part of a single order and they are delivered uniformly;
• on which you or a third party named by you, who is not the carrier, took possession of the last item, provided you ordered multiple goods as part of a single order and they are delivered separately;

To exercise your right of withdrawal, you must inform us (Third of Life GmbH, Otto-Heilmann-Str. 17, 82031 Grünwald, Phone: +49 (0)89 44 35 55 04, Fax: +49 (0)89 99 95 40 76, Email: service@third-of-life.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, excluding the proportional return shipping costs of 5 EUR per return (except for additional costs arising if you chose a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the day we receive the notification of your withdrawal. We will use the same payment method you used for the original transaction unless expressly agreed otherwise; in no case will you incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided proof of having sent the goods back, whichever is earlier.

You must return or hand over the goods to us  or to Third of Life GmbH, Salzstraße 8, 85622 Feldkirchen without undue delay and in any event no later than 14 days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

We do not bear the costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.

Exclusions and Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts

• for the delivery of goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
• for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
• for the delivery of alcoholic beverages, the price of which was agreed upon at the time of contract conclusion but which can only be delivered at least 90 days after contract conclusion and whose current value depends on market fluctuations beyond the entrepreneur’s control;
• for the delivery of newspapers, magazines, or illustrated magazines except for subscription contracts.

The right of withdrawal expires prematurely for contracts

• for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery;
• for the delivery of goods that are inseparably mixed with other goods after delivery due to their nature;
• for the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.
