Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed to their professional, commercial, or independent activity.)

This contract can be terminated within 1 month without the obligation to specify the reasons.

The withdrawal period is 1 month starting from the date

• on which you or a third party appointed by you, who is not the carrier, have taken delivery of the goods, if you ordered one or more goods as part of a single order and these goods are delivered in a single shipment;
• on which you or a third party appointed by you, who is not the carrier, have taken delivery of the last good, if you ordered multiple goods as part of a single order and these are delivered separately;

To exercise your right of withdrawal, you must inform us (Third of Life GmbH, Aaröstr. 24, 81929 Munich, Phone number: +49 (0)89/ 44 35 55 04, Fax number: +49 (0)89 / 80 03 57 87, Email address: service@third-of-life.com) by means of a clear statement (e.g., a letter sent by post, fax, or email) regarding your decision to withdraw from the contract. You may use the attached sample withdrawal form for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that the communication concerning the exercise of the right of withdrawal is sent before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we are obliged to refund all payments received from you, including shipping costs (except for additional costs resulting from your choice of a delivery method other than the most economical standard delivery offered by us), immediately and no later than 14 days from the date on which we received your notification of withdrawal from this contract. We will use the same payment method you used for the original transaction unless explicitly agreed otherwise; under no circumstances will you be charged fees for this refund.

We may withhold the refund until we have received the goods back or you have provided proof of having sent the goods back, whichever is earlier.

You must send back or hand over the goods to us immediately and in any case no later than 14 days from the date on which you inform us of the withdrawal from this contract or to Third of Life GmbH, Salzstraße 8, 85622 Feldkirchen. The deadline is met if you send the goods before the 14-day period expires.

We will bear the costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods beyond what is necessary to check their condition, characteristics, and functioning.

Exclusions or Termination of the Right of Withdrawal

The right of withdrawal does not apply to contracts

• for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the consumer’s personal needs;
• for the supply of goods that deteriorate rapidly or whose expiration date would be quickly exceeded;
• for the supply of alcoholic beverages whose price was agreed upon at the time of contract conclusion but which may be delivered no earlier than 30 days after the contract date and whose current value depends on market fluctuations beyond the entrepreneur’s control;
• for the supply of newspapers, magazines, or illustrated magazines, except for subscription contracts.

The right of withdrawal expires prematurely for contracts

• for the supply of goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;
• for the supply of goods which, after delivery, have been inseparably mixed with other items due to their nature;
• for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
