Right of withdrawal for consumers

(A ‘consumer’ is any natural person who enters into a legal transaction that is predominantly not related to their commercial or independent professional activities.)

Right of withdrawal

You have the right to withdraw from this contract within one month without giving any reason.

The withdrawal period is one month starting from the day,

• on which you or a third party appointed by you, who is not the carrier, took possession of the products, provided you ordered one or more products as part of a single order and this/these product(s) are delivered at once;
• on which you or a third party appointed by you, who is not the carrier, took possession of the last product, provided you ordered multiple products as part of a single order and these products are delivered separately;

To exercise your right of withdrawal, you must inform us (Third of Life GmbH, Aaröstr. 24, 81929 Munich, Telephone number: +49 (0)89/ 44 35 55 04, Fax number: +49 (0)89 / 80 03 57 87, Email address: service@third-of-life.com) of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), immediately and no later than 14 days from the day we receive your notification of withdrawal. We will use the same payment method you used for the original transaction unless expressly agreed otherwise; you will not incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the products back or you have provided evidence of having sent the products back, whichever occurs first.

You must return or hand over the products to us or to Third of Life GmbH, Salzstraße 8, 85622 Feldkirchen without delay and in any event no later than 14 days from the day you notify us of the withdrawal from this contract. The deadline is met if you send the products before the 14-day period expires.

We will bear the costs of returning the products.

You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products.

Exclusion and expiry criteria

The right of withdrawal does not apply to contracts

• for the delivery of products that are not prefabricated and for which an individual selection or specification by the consumer is essential or which are clearly tailored to the personal needs of the consumer;
• for the delivery of products that can spoil quickly or whose expiration date would be exceeded quickly;
• for the delivery of alcoholic beverages, the price of which was agreed upon at the time of contract conclusion but which can be delivered no earlier than 30 days after the contract was concluded and whose current value depends on market fluctuations beyond the entrepreneur’s control;
• for the delivery of newspapers, periodicals, or magazines except for subscription contracts.

The right of withdrawal expires prematurely for contracts

• for the delivery of sealed products that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;
• for the delivery of products that have been inseparably mixed with other goods after delivery due to their nature;
• for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
